SwapYourVacationHome.com Affiliate Program Agreement
Introduction
This is an agreement between JC2T Inc. ("The Company") and a third party ("The Applicant").
JC2T Inc. of 710 S. Division St. Carson City, Nevada 89703-5147, owns and operates SwapYourVacationHome.com.
The Company and the Applicant wish to engage in a business relationship. The Applicant seeks to become an Affiliate of SwapYourVacationHome.com. The Affiliate shall market SwapYourVacationHome.com's services. The Company shall pay the Affiliate according to the criteria described in this agreement.
Termination of Agreement
The Company may alter or terminate this Agreement at any time and for any reason. Reasons for termination include but are not limited to: illegal or fraudulent activity; defamation of the Company or SwapYourVacationHome.com; and unauthorized access to JC2T Inc.'s computer systems. In case of termination, all technical implementations associated with the Affiliate, such as click-through links, may experience degraded functionality.
Affiliate Program Application
The Applicant will submit an Affiliate Program Application to the Company. The application requires the Applicant to disclose personal information such as their legal name and business address. The Company will use the information provided in the application for the sole purposes of the Affiliate Program and will not share this information with third parties (except in cases of suspected fraud committed by the Applicant) (excepting law enforcement agencies that provide appropriate court documents).
The Company strives to respond to applications more quickly than the industry standard. The Company will determine whether to approve the Applicant within 15 business days after the application is submitted; however, shorter response times are common. If the Company accepts the application, the Applicant shall become an Affiliate of SwapYourVacationHome.com. The Company is not obligated to provide decision criteria.
Affiliate ID
Each Affiliate will be assinged a unique Affiliate ID which will not contain any personally identifiable information.
Qualifying Memberships
Affiliates may be paid for Qualifying Memberships only, which are limited to:
- New Members Only
- Affiliates who encourage members to cancel their memberships and sign up using their Affiliate ID will be terminated
- The Member can not be the Affiliate
- Paid Memberships Only
- Silver, Gold, and Platinum all qualify as paid memberships
- If a Gold member downgrades from Gold to Standard or cancels their membership, there will be no for that membership
- Only Members who Sign Up Using the Affiliate's ID
- Links that are hosted on the Affiliate's web pages will contain the Affiliate ID automatically
- A cookie that expires after 60 days will also contain the Affiliate ID, in case a visitor signs up a few days after clicking on the Affiliate's link
Payment
The Company will pay the Affiliate percentages of actual dues collected from Qualifying Memberships (see above).
The payment schedule is as follows:
- Only actual membership dues (list price minus discounts) collected by the Company in full are used to calculate payouts
- 50% of the actual dues collected for the first month of a qualifying membership
- 30% of the actual dues collected for subsequent months of a qualifying membership
Amounts are rounded to the nearest penny.
For illustration, please consider the following example:
- An Affiliate directs a new member A to sign up for Gold membership in January. The Company receives $19.95
- In February, the Affiliate receives a payment for $9.98
- In February, the Affiliate directs a new member B to sign up for Platinum membership. The Company receives $95.95
- In February, the Company receives $19.95 for member A
- In March, the Affiliate receives a payment for $53.96
- In March, the Company receives $19.95 for member A and $95.95 for member B.
- In April, the Affiliate receives a payment for $34.77
- In May, the Affiliate receives a payment for $34.77
Processing and Delivery Schedule
- Payments are calculated on the 5th of each month for the previous month
- Payments are processed by the 10th of each month
- Payments are sent by the 15th of each month via standard US mail
Information Gathering, Reporting, and Purging
The Company may collect information using Internet cookies that expire within 60 days and other technologies in order to enhance the Affiliate Program. This information will not be shared with third parties.
The Company may purge reports and other data at any time.
Lost Payments
Affiliates are encouraged to make sure that SwapYourVacationHome.com has their up-to-date mailing address. All changes may be sent to affiliate@swapyourvacationhome.com.
In the event that an Affiliate has not received payment from the Company by the 28th of the month, the Affiliate may submit an inquiry to affiliate@swapyourvacationhome.com. The Company will determine within 40 business days after the payment was sent whether the payment was received. If the Company determines that payment was received, the Company will not in any circumstance send an additional payment. Otherwise, the Company will cancel the previous payment and send another payment within 20 additional business days.
Dispute Policy
Affiliates may submit their concerns to affiliate@swapyourvacationhome.com. The Company's decisions shall be final.
Indemnification
In no event shall the Company be held liable for the Affiliate's financial or other losses such as, but not limited to, finance charges, computer system outages, data loss, or information disclosure.
